Criminal Record Expungement – the Way To “Clear” Your Criminal Record

In California, you have the ability to clean up your criminal record pursuant to Penal Code Section 1203.4. While many people refer to this as expungement, it does have its limits. In states outside of California, a true expungement is when someone petitions the court to wipe clean their criminal record entirely so an employer or other person would never see that they had ever even been arrested.
In California, we don't have that luxury, but we absolutely can help clients clear up their criminal record as best we can. The way that we do that is to petition the court under certain circumstances to allow a convicted person to go back in court and withdraw their plea. As a result of that, the court will enter a dismissal of the charge so an individual's record will show that even though they might have been cited or arrested for this crime, that ultimately the charge against them was dismissed.
Because employers can't use dismissals or charges alone against someone for most types of employment purposes, this is to great benefit of most of our clients.
