Newport Beach DUI Attorney

Newport Beach has a well-deserved reputation for beauty, but also for having a lively restaurant, bar and club scene that attracts people from across the southern California region. It is also an area, like most non-urban areas in the US, with a culture of driving. Newport Beach law enforcement is strict on drunk driving because of this. But if you get arrested for a DUI after a night out, the Newport Beach DUI attorney at the Johnson Criminal Law Group has experience in defending DUIs in California.

California Vehicle Code 23152 is the applicable law for DUIs, and the section states in part that it’s unlawful for any person who is under the influence of any alcoholic beverage or drug to drive a vehicle. The limit for driving is 0.08 percent blood alcohol level or more in your blood system. Your BAC (blood alcohol concentration) measures the amount of alcohol in your blood stream. There are a number of different factors that can affect your BAC, including your gender, body size, the number of drinks you ingested, what type of alcohol you consumed, and over what period of time. For example, if a one hundred twenty pound women were to drink two shots of hard liquor over a period of five minutes, the results of her BAC would be drastically different from a two hundred pound man that drank the same type and amount of alcohol over the course of an hour. Nevertheless, as soon as one reaches a BAC of 0.08%, they are considered too drunk to drive. With that level of a BAC, the functions you use in order to drive are seriously impaired. You are no longer considered capable to safely operate a motor vehicle because of how alcohol can affect one’s vision, balance, and coordination. With commercial drivers, a BAC of half that, or a BAC of 0.04% or higher, can get you charged with a DUI. For those under the age of twenty one, a BAC of 0.0.1% or higher can result in a DUI. DUI laws are put in place to regulate the safe and sober operation of motor vehicles. While driving while under the influence most definitely puts the intoxicated driver in danger, many forget that they are endangering the lives of those around them on the road, as well.

After the first time you are charged with a DUI, the charges increase in severity and the penalties become heavier in the amount of fines, possible jail time, and how long your license is suspended. Too many people think a DUI is not a big deal and then are surprised when their driver’s license is suspended or they face serious jail time and fines. The Newport Beach DUI attorney at the Johnson Criminal Law Group knows that a DUI arrest or conviction can have serious consequences, and she has experience defending these cases to attain the best possible outcome for the client. Don’t make the mistake of thinking this is not a serious issue if you have been arrested for a DUI.
